1. Acceptance of these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the websites, services and platforms operated by Online Classics Pty Ltd ABN 70 669 386 181, trading as RetroRides, RR Auctions and RR Finance (“we”, “our” or “us”).

Our services include, without limitation:

  • Online vehicle auctions;
  • Vehicle marketplace and classified listings;
  • Buy Now vehicle sales;
  • Expressions of Interest;
  • Editorial content and buyer guides;
  • Finance referral services;
  • Insurance referral services;
  • Events, promotions and related automotive services.

By accessing our Website, creating an account, listing a vehicle, bidding, purchasing a vehicle or using any of our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our Website or services.

2. Changes to these Terms

We may amend these Terms at any time.

Any amended Terms become effective immediately upon publication on our Website unless otherwise stated.

Your continued use of the Website constitutes acceptance of the amended Terms.

3. Eligibility

To use our services you must:

  • be at least 18 years of age;
  • have legal capacity to enter into binding contracts;
  • provide accurate and complete information;
  • comply with all applicable Australian laws.

We may refuse or cancel any registration at our absolute discretion.

4. User Accounts

You must register an account before accessing certain services.

You agree to:

  • maintain accurate account information;
  • keep your password secure;
  • immediately notify us of any unauthorised access.

Each individual may maintain only one account unless approved by us.

You remain responsible for all activity conducted through your account.

5. Identity Verification

To protect buyers and sellers, we may require identity verification before permitting participation in auctions or other services.

Verification may include:

  • Government-issued identification;
  • Proof of residential address;
  • Credit card verification;
  • Electronic identity verification;
  • Anti-fraud screening;
  • Any additional information reasonably requested by us.

Identity verification may be undertaken by approved third-party providers.

Failure to complete verification may prevent access to some or all services.

6. Website Use

You agree not to:

  • interfere with Website operations;
  • attempt unauthorised access;
  • upload malicious software;
  • copy, scrape or harvest Website content;
  • impersonate another person;
  • manipulate auctions or listings;
  • use automated bidding software without our written approval.

We may suspend or terminate access where misuse is suspected.

7. Our Services

RetroRides operates an online automotive marketplace connecting buyers and sellers.

Depending upon the transaction, we may act as:

  • marketplace operator;
  • auction facilitator;
  • marketing agent;
  • referral partner.

Unless expressly stated, we are not the owner of vehicles listed for sale.

Ownership remains with the Seller until settlement has been completed.

8. Vehicle Listings

Sellers warrant that they:

  • own the vehicle or have authority to sell it;
  • are legally entitled to transfer ownership;
  • have provided information that is true and accurate to the best of their knowledge;
  • have disclosed known material defects where reasonably expected.

While we review listings before publication, we do not independently verify every statement made by a Seller.

Vehicle descriptions, photographs, videos and documentation are provided for general information only.

Buyers must undertake their own inspections and due diligence before bidding or purchasing.

9. Auctions

Each auction will display:

  • commencement time;
  • closing time;
  • reserve status (where applicable);
  • bidding increments.

Every bid submitted is irrevocable and legally binding.

The highest accepted bid when an auction closes creates a binding contract between the Buyer and Seller.

If bidding occurs during the final countdown period, the auction may automatically extend to provide all bidders with a fair opportunity to bid.

We reserve the right to:

  • reject or remove bids;
  • extend or restart an auction;
  • withdraw a listing;
  • correct obvious errors;
  • refuse participation;
  • cancel an auction where required to protect the integrity of the marketplace.

10. Buy Now Listings

Where a vehicle is offered for immediate purchase:

  • acceptance of the advertised price creates a binding contract;
  • settlement obligations commence immediately;
  • the Seller may withdraw the listing at any time before acceptance.

11. Expressions of Interest

An Expression of Interest listing is an invitation to negotiate only.

Submitting an enquiry:

  • does not reserve the vehicle;
  • does not create a contract;
  • does not guarantee availability.

A legally binding agreement exists only when Buyer and Seller enter into a separate agreement to purchase the vehicle.

12. Bidding Rules

12.1 Every bid placed through RR Auctions constitutes a legally binding offer to purchase the relevant vehicle.

12.2 By placing a bid, the bidder warrants that they:

  1. a) have read the vehicle listing in full;
  2. b) have undertaken all inspections and enquiries they consider necessary, or have elected not to do so;
  3. c) understand and accept these Terms; and
  4. d) have the financial capacity to complete the purchase.

12.3 Bids cannot be withdrawn once submitted except where required by law or expressly approved by RR Auctions.

12.4 Reserve prices remain confidential unless otherwise stated.

12.5 Where the reserve price is not met, RR Auctions may facilitate negotiations between the Seller and the highest bidder.

12.6 RR Auctions may reject, remove or cancel any bid where it reasonably believes:

  • fraud or unlawful conduct has occurred;
  • a bidding error has been made;
  • the bidder has breached these Terms;
  • the integrity of the auction has been compromised.

12.7 The decision of RR Auctions regarding bidding disputes, auction timing and auction outcomes is final.

13. Purchaser Obligations

13.1 A successful bidder immediately enters into a legally binding agreement with the Seller.

13.2 The Purchaser must:

  • pay all amounts owing within the required timeframe;
  • complete all required documentation;
  • provide any requested identification;
  • arrange collection or transport of the vehicle;
  • comply with all registration and transfer requirements.

13.3 A Purchaser must not delay settlement pending finance approval, transport arrangements, inspections or any other matter unless expressly agreed in writing by RR Auctions.

14. Payment

14.1 Payment must be made using payment methods approved by RR Auctions.

14.2 Unless otherwise agreed in writing:

  • any deposit is payable immediately; and
  • the balance of the Purchase Price must be paid within the timeframe specified by RR Auctions.

14.3 Settlement is complete only when cleared funds have been received.

14.4 RR Auctions may refuse any payment method considered unsuitable.

14.5 Credit card processing fees may apply where permitted by law.

14.6 Any costs associated with international transfers, foreign exchange or bank charges remain the Purchaser’s responsibility.

15. Buyer’s Premium

15.1 Every successful purchase is subject to the Buyer’s Premium displayed on the relevant vehicle listing unless otherwise stated.

15.2 The Buyer’s Premium forms part of the total amount payable by the Purchaser.

15.3 GST applies where required by Australian law.

15.4 The Buyer’s Premium is earned upon completion of a binding sale and is non-refundable except where required by law.

16. Settlement

16.1 Settlement must occur within the period specified by RR Auctions or the Seller.

16.2 Settlement is complete only when:

  • cleared funds have been received in full;
  • all contractual obligations have been satisfied; and
  • all required documentation has been completed.

16.3 The Seller is not required to release the vehicle until RR Auctions has confirmed that settlement has been completed in accordance with these Terms.

16.4 RR Auctions may delay or suspend settlement where it reasonably believes there is a dispute, suspected fraud, identity verification issue, payment irregularity, legal restriction or any circumstance that may compromise the integrity of the transaction. RR Auctions will not be liable for any loss arising from such delay where it has acted reasonably and in good faith.

17. Delivery and Collection

17.1 Unless otherwise agreed, collection and transport of the vehicle are the Purchaser’s responsibility.

17.2 The Purchaser assumes all costs associated with transport, insurance and delivery following settlement.

17.3 Where collection is delayed beyond the agreed timeframe, the Seller may charge reasonable storage costs.

17.4 RR Auctions is not responsible for transport delays or the acts or omissions of third-party carriers.

18. Title and Risk

18.1 Legal ownership of the vehicle transfers only after:

  • settlement has been completed; and
  • the Seller has authorised release of the vehicle.

18.2 Risk passes to the Purchaser upon collection or delivery of the vehicle, whichever occurs first.

18.3 The Purchaser is responsible for arranging appropriate insurance from the time risk passes.

19. Purchaser Default

19.1 A Purchaser is in default if they fail to:

  • complete settlement;
  • pay any amount owing;
  • comply with these Terms; or
  • otherwise complete the transaction.

19.2 Where a Purchaser defaults, RR Auctions and/or the Seller may, without limiting any other rights available at law:

  1. a) terminate the sale;
  2. b) retain any deposit paid;
  3. c) retain or recover the Buyer’s Premium;
  4. d) re-list or re-auction the vehicle;
  5. e) suspend or permanently terminate the Purchaser’s account; and
  6. f) recover from the Purchaser all reasonable losses, costs and expenses arising from the Purchaser’s default, including but not limited to:
  • the Buyer’s Premium;
  • commissions payable to RR Auctions;
  • vehicle storage costs;
  • transport and recovery costs;
  • advertising and marketing expenses;
  • administration costs;
  • legal costs on a full indemnity basis;
  • debt collection and recovery costs;
  • any reduction in the resale price of the vehicle; and
  • any other reasonable loss suffered by the Seller or RR Auctions as a direct result of the Purchaser’s default.

19.3 Where a Purchaser fails to pay the Buyer’s Premium or any other amount due under these Terms, RR Auctions reserves the right to commence legal proceedings to recover all outstanding amounts together with interest (where permitted by law), legal costs, debt recovery costs and any other reasonable costs incurred in enforcing its rights.

19.4 RR Auctions may offset any monies held on behalf of the Purchaser against any outstanding amounts owed.

20. Seller Obligations

20.1 The Seller warrants that they:

  • own the vehicle or are authorised to sell it;
  • are legally entitled to transfer good title;
  • have disclosed all material information known to them;
  • have not knowingly provided false or misleading information.

20.2 The Seller acknowledges that RR Auctions relies upon the information supplied by the Seller when marketing the vehicle.

20.3 The Seller indemnifies RR Auctions against any claim, loss, liability or expense arising from inaccurate, misleading or incomplete information supplied by the Seller.

20.4 RR Auctions may refuse, suspend, amend or remove any listing at its absolute discretion.

20.5 Exclusive Appointment

By signing a Consignment Agreement or otherwise instructing RR Auctions to market or sell a vehicle, the Seller appoints RR Auctions as the exclusive agent for the sale of that vehicle for the duration of the listing and auction period and 30 days after the conclusion of the Auction.

20.6 Post-Auction Exclusivity

The Seller agrees not to sell, transfer or otherwise dispose of the vehicle to any person who became aware of, inspected, enquired about or negotiated in relation to the vehicle through RetroRides or RR Auctions during the listing or auction period for a period of thirty (30) days following the close of the auction unless the sale is completed through RR Auctions.

20.7 Anti-Circumvention

The Seller must not directly or indirectly circumvent RR Auctions by entering into a private sale or other arrangement with any bidder, prospective purchaser or enquiry introduced through RetroRides or RR Auctions for the purpose of avoiding commissions, fees or other amounts payable under the Consignment Agreement or these Terms.Where this clause is breached, RR Auctions may recover from the Seller:

  • all commissions and fees that would have been payable;
  • advertising and marketing costs;
  • reasonable legal and debt recovery costs; and
  • any other reasonable losses suffered as a result of the breach.

20.8 Seller Withdrawal

Once a Consignment Agreement has been executed and the vehicle has been listed for sale, the Seller may not withdraw the vehicle without the prior written consent of RR Auctions. Where RR Auctions agrees to the withdrawal, the Seller remains liable for any agreed withdrawal fee together with all reasonable advertising, photography, marketing and administration costs incurred in relation to the listing.

PART 3 – FINANCE, LIABILITY & GENERAL TERMS

21. RR Finance

21.1 RR Finance is a finance referral service operated by Online Classics Pty Ltd to assist prospective purchasers in obtaining vehicle finance.

21.2 All credit assistance and finance services promoted through RR Finance are provided by:

21.3 Online Classics Pty Ltd trading as RetroRides, RR Auctions and RR Finance is not the credit provider and does not provide credit assistance, financial advice or lending services. We act solely as a marketing and referral partner introducing prospective borrowers to Lodge IQ Pty Ltd.

21.4 Any finance application is assessed solely by Lodge IQ Pty Ltd and/or its panel of lenders. Finance approval is subject to responsible lending obligations, lender policies and individual eligibility criteria.

21.5 Finance calculators, repayment estimates, indicative interest rates and other finance information displayed on the Website are estimates only and do not constitute a loan approval or binding offer.

21.6 Applying for finance does not alter a Purchaser’s obligations under these Terms. A successful bidder remains responsible for completing settlement regardless of whether finance has been approved, delayed or declined.

21.7 By submitting a finance enquiry, you authorise RR Auctions to disclose your personal information to Lodge IQ Pty Ltd and its lending partners for the purpose of assessing your finance application.

21.8 RR Auctions accepts no responsibility for any loss arising from the refusal, delay or withdrawal of finance by Lodge IQ Pty Ltd or any participating lender.

22. Insurance Referrals

22.1 RR Auctions may introduce Buyers and Sellers to insurance providers.

22.2 Any insurance product is provided by the relevant insurer or authorised representative and not by RR Auctions.

22.3 RR Auctions does not provide insurance advice and accepts no responsibility for insurance decisions made by third parties.

23. Privacy

23.1 We collect, store and use personal information in accordance with our Privacy Policy and applicable Australian privacy laws.

23.2 You consent to us using your personal information to:

  • verify your identity;
  • administer your account;
  • facilitate vehicle transactions;
  • communicate with Buyers and Sellers;
  • provide finance and insurance referrals;
  • comply with legal obligations.

23.3 We may disclose personal information to:

  • Sellers and Purchasers;
  • finance providers;
  • insurers;
  • transport providers;
  • payment processors;
  • identity verification providers;
  • government authorities where required by law.

24. Australian Consumer Law

24.1 Nothing in these Terms excludes, restricts or modifies any rights that cannot legally be excluded under the Australian Consumer Law.

24.2 Where permitted by law, all implied warranties and conditions are excluded.

24.3 Vehicles sold by auction may not attract certain statutory consumer guarantees under the Australian Consumer Law.

24.4 Buyers acknowledge that used collector, performance and classic vehicles may contain faults consistent with their age, condition and intended use.

25. Vehicle Condition

25.1 Unless expressly stated otherwise, every vehicle is sold “as is, where is.”

25.2 Buyers are responsible for undertaking their own inspections, mechanical assessments, PPSR searches and due diligence before purchasing.

25.3 Vehicle descriptions, photographs, videos and opinions are provided for general information only.

25.4 RR Auctions does not warrant:

  • originality;
  • authenticity;
  • roadworthiness;
  • mechanical condition;
  • suitability for registration;
  • investment potential;
  • future value.

26. Limitation of Liability

26.1 To the maximum extent permitted by law, RR Auctions is not liable for any indirect, incidental, consequential or economic loss arising from use of the Website or any transaction facilitated through it.

26.2 RR Auctions acts primarily as a marketplace facilitator and is not responsible for:

  • statements made by Sellers;
  • Purchaser conduct;
  • transport providers;
  • finance providers;
  • insurers;
  • delays outside our reasonable control.

26.3 Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted by law.

27. Indemnity

You agree to indemnify and hold harmless Online Classics Pty Ltd, its directors, employees, contractors and agents against any claim, liability, loss, damage, cost or expense arising from:

  • your breach of these Terms;
  • your misuse of the Website;
  • your unlawful conduct;
  • inaccurate information supplied by you; or
  • any claim brought by another party arising from your actions.

28. Intellectual Property

28.1 All Website content including text, logos, photographs, graphics, videos, software and branding remains the property of Online Classics Pty Ltd or its licensors.

28.2 No material may be copied, reproduced or distributed without prior written consent.

28.3 Sellers grant RR Auctions a royalty-free licence to use photographs, videos and descriptions supplied for the purpose of marketing the vehicle during the listing period and for archival, promotional and historical purposes after the listing concludes.

29. Suspension and Termination

RR Auctions may suspend or terminate any account immediately where we reasonably believe a user has:

  • breached these Terms;
  • provided false information;
  • failed to complete a transaction;
  • acted fraudulently;
  • interfered with the operation of the Website;
  • engaged in abusive, unlawful or unethical conduct.

Termination does not affect any accrued rights or obligations.

30. Force Majeure

RR Auctions is not liable for any delay or failure to perform its obligations where performance is prevented by circumstances beyond its reasonable control including natural disasters, cyber attacks, telecommunications failures, government action, industrial disputes or other force majeure events.

31. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

32. General

32.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

32.2 Failure by RR Auctions to enforce any right does not constitute a waiver of that right.

32.3 These Terms constitute the entire agreement between the parties relating to the use of the Website and supersede any prior representations or agreements unless expressly stated otherwise in writing.

32.4 These Terms should be read together with any applicable:

  • Consignment Agreement;
  • Auction Listing;
  • Vehicle Listing;
  • Privacy Policy;
  • Fee Schedule; and
  • any special conditions published by RR Auctions for a particular auction or sale.

33. Definitions

For the purposes of these Terms:

  • Buyer means the successful purchaser of a vehicle.
  • Buyer’s Premium means the fee payable by the Buyer in addition to the Purchase Price.
  • Consignment Agreement means the agreement between the Seller and RR Auctions authorising RR Auctions to market and facilitate the sale of a vehicle.
  • Purchase Price means the accepted purchase price excluding the Buyer’s Premium unless stated otherwise.
  • Purchaser means a successful Buyer.
  • RR Auctions means Online Classics Pty Ltd trading as RR Auctions.
  • RR Finance means the finance referral service operated by Online Classics Pty Ltd.
  • Seller means the owner or authorised representative of the vehicle.
  • Settlement means completion of payment, documentation and authorisation for release of the vehicle.
  • Website means any website, mobile application or online platform operated by Online Classics Pty Ltd, including RetroRides, RR Auctions and RR Finance.

Shipping Policy

Shipping Costs

All shipping costs are automatically calculated at checkout based on your delivery location, order size, and the shipping service selected.

Order Processing

All merchandise is produced to order through our fulfilment partners. Orders are typically processed within 2–5 business days before dispatch.

Please note that processing times may increase during peak periods, promotional events, or public holidays.

Delivery Timeframes

Estimated delivery times commence once your order has been dispatched:

  • Australia Metro Areas: 2–7 business days
  • Regional Australia: 5–10 business days
  • International Orders: Delivery times vary by destination

Delivery timeframes are estimates only and may be affected by factors outside our control, including carrier delays and customs processing.

Tracking Information

Where available, tracking details will be provided via email once your order has been dispatched.

Multiple Shipments

Some orders may be fulfilled and shipped separately depending on product type, availability, or fulfilment location. Customers will receive tracking information for each shipment where applicable.

Returns, Refunds & Exchanges Policy

Made-to-Order Products

All Retro Rides merchandise is custom produced once an order is placed. As such, we are unable to offer refunds, returns, or exchanges for:

  • Change of mind
  • Incorrect size selection
  • Incorrect colour selection
  • Customer preference after delivery
  • Orders placed with an incorrect shipping address supplied by the customer

Please review product descriptions, sizing guides, colours, and shipping information carefully before completing your purchase.

Damaged, Defective or Incorrect Orders

If your order arrives:

  • Damaged
  • Defective
  • Misprinted
  • Incorrectly produced
  • Different from the item ordered

Please contact us within 14 days of receiving your order.

To assist with your claim, please provide:

  • Your order number
  • A description of the issue
  • Clear photographs showing the problem

Once reviewed and approved, we will arrange either:

  • A replacement item, or
  • A full refund

at no additional cost to you.

Lost or Missing Orders

If your order has not arrived within the expected delivery timeframe, please contact us as soon as possible.

We will work with our fulfilment partner and shipping carrier to investigate the shipment and determine the most appropriate resolution.

Refund Processing

Approved refunds will be returned to the original payment method used for purchase.

Please allow up to 5–10 business days after processing for funds to appear in your account, depending on your financial institution.

Order Changes & Cancellations

Because merchandise production begins shortly after an order is placed, we cannot guarantee changes or cancellations once an order has been submitted.

If you need to make a change, please contact us immediately and we will do our best to assist before production commences.

Australian Consumer Law

Nothing in this policy excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

Where a product experiences a major failure or does not meet consumer guarantees, you may be entitled to a repair, replacement, or refund as provided under applicable Australian legislation.
